1. Definitions

The following terminology applies to these Terms and Conditions, Privacy Statement, and all agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to Spartan Painting LLC. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of the State of TX, United States.

2. Services & Project Scope

Spartan Painting LLC provides professional residential and commercial painting services, including interior painting, exterior painting, cabinet refinishing, commercial painting, deck & fence staining, drywall & carpentry repairs, and related surface preparations. The specific scope of work, including preparation, material selections, color schemes, quantities, and schedule for any physical project will be outlined in a separate, written, and signed project contract or estimate proposal.

While we strive to provide accurate service representations on this website, any information provided online is for informational purposes and does not modify the terms of a written contract. We reserve the right to amend, suspend, or discontinue any of our services without prior notice.

3. Estimates, Pricing & Payment Terms

• Free Estimates: Estimates provided by Spartan Painting LLC are valid for the period stated on the estimate itself. Estimates are based on visual inspections and assumptions regarding underlying surface conditions.
• Price Commitments: Spartan Painting LLC believes in transparent, honest pricing. Once a contract is signed, the price is fixed, except in cases where hidden wood rot, structural water damage, plaster failure, or customer-requested changes (change orders) occur. All change orders must be agreed upon in writing before the work is executed.
• Payment Schedules: A standard deposit may be required to secure scheduling dates, especially during peak painting seasons. Progressive or milestone payments may be outlined for large commercial contracts. The final balance is due immediately upon the successful completion of a final project walkthrough with Carlos or the designated site manager.
• Late Payments: Overdue balances may be subject to interest or late charges as set out in your signed project agreement.

4. Preparation & Client Responsibilities

We take pride in our preparation processes (pressure washing, bio-washing, scraping, priming, caulking). To help us work efficiently and safely, the Client agrees to:

• Remove all small items, breakables, wall art, and electronics from the rooms scheduled to be painted.
• Provide clear access to work areas, including moving vehicles from driveways, clearing clutter from walls, and keeping pets and children clear of active work zones.
• Ensure water and electrical outlets are functional and accessible for our pressure washers and spray systems.
• Coordinate approvals from Homeowners Associations (HOA) or municipal permits if required for color changes or exterior alterations.

5. Warranty & Guarantee Policies

Spartan Painting LLC stands behind our workmanship. We provide a limited 3-Year Warranty on Interior & Exterior Projects. We back every interior and exterior project with our 3-year warranty.

• Coverage: This warranty covers paint peeling, bubbling, blistering, or flaking resulting directly from improper surface preparation or application errors by our painters, for a period of 3 years from the date of project completion, as specified in your agreement.
• Exclusions: The warranty does not cover damage caused by settling structures, structural rot, moisture issues originating behind the siding or drywall, normal wear and tear, mechanical damage, customer cleaning chemicals, or weather events (hail, storms, wind-driven debris, flooding).
• Claims Process: To make a warranty claim, contact Carlos at spartanpaintingsa@gmail.com with your original invoice number and pictures of the affected area. Spartan Painting LLC will inspect the claim and perform necessary repairs at no charge if deemed application-related.

6. SMS/Text Message Consent Terms

By opting into text communication via our estimate forms, you agree to receive SMS communications regarding scheduling, estimate reminders, arrival times, and billing confirmations. Standard carrier message and data rates may apply. You may text "STOP" at any time to cancel SMS communications. We will not share your mobile phone number with third parties for marketing purposes.

7. Intellectual Property

Unless otherwise stated, Spartan Painting LLC and/or its licensors own the intellectual property rights for all material on our website. All intellectual property rights are reserved. You may view and/or print pages from https://spartanpainting.net for your own personal use subject to restrictions set in these terms and conditions.

You must not:

• Republish material from this website.
• Sell, rent, or sub-license material from this website.
• Reproduce, duplicate, or copy material from this website.
• Redistribute content from Spartan Painting LLC (unless content is specifically made for redistribution).

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Spartan Painting LLC, its owner Carlos Estrada, or its crew members be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this website or our physical services.

In any dispute, the maximum total liability of Spartan Painting LLC shall not exceed the total cash contract amount paid by the Client to Spartan Painting LLC for the specific project in question.

9. Governing Law & Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of the State of TX, United States, and you irrevocably submit to the exclusive jurisdiction of the state and federal courts located in the county where Spartan Painting LLC maintains its principal place of business for resolution of any contractual disputes.
